This website and the various content, features, products and services (collectively, the “Site”) are owned and/or operated by Transfemme and Avalon Essentials, LLC. (collectively, ” Avalon Essentials, LLC,” “we,” “us,” “our,” or similar pronouns). Avalon Essentials, LLC is committed to respecting your online privacy and recognizes your need for appropriate protection and management of the information you share with us. Avalon Essentials, LLC has established this privacy and security policy (“Privacy Policy”) to let you know what information we may collect from you on the Site and how we may use and share that information. Please take a moment to review the terms of our Privacy Policy. By using the Site, you agree to accept the terms of our Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use the Site. Except as expressly provided herein, this Privacy Policy applies only to information that we collect on the Site and does not apply to information that we may collect by other means.
2. Personal Information; Changes to Personal Information
Personal Information means any information that may be used to identify an individual, including, but not limited to, first and last name, home or other physical address, telephone number, e-mail address, or credit card information.
You can visit the Site without telling us who you are or revealing any Personal Information about yourself. However, we require you to provide Personal Information to purchase on the Site. Moreover, other features or services may require you to provide Personal Information. For example, we may collect certain Personal Information if you subscribe to a mailing list, participate in special offers, contests, sweepstakes, or other promotions, or send questions or comments to us via e-mail, text messages, messenger, or WhatsApp. Should you purchase any products on the Site, we will collect Personal Information from you, which we will use to fulfill your order and for other purposes consistent with this Privacy Policy.

From time to time, Avalon Essentials, LLC may collect general, non-personal, statistical information about the use of the Site, such as how many visitors visit a specific page on the Site, how long they stay on that page, and which hyperlinks, if any, they “click” on. We collect this information to determine which areas of the Site are most popular and to enhance the Site for visitors. However, we do not share this Personal Information with third parties. The Site may also use a technology called “tracer tags”. These may also be referred to as “Clear GIFs” or “Web Beacons”. This technology allows us to understand which pages you visit on the Site. These tracer tags help us optimize and tailor the Site for you and other Site visitors.

With Whom We May Share Your Information
Avalon Essentials, LLC does not share your Personal Information with third parties for their direct marketing purposes. However, as outlined in this Privacy Policy, we may disclose your Personal Information to third parties for other purposes.
We may sometimes use other businesses to perform certain services, such as maintaining the Site and our mailing lists, processing orders and delivering products, sending postal mail, and providing marketing assistance and data analysis. We may provide Personal Information to those businesses when that information is necessary for them to complete a requested transaction or otherwise perform their duties.
As Avalon Essentials, LLC develops, we may buy other businesses or their assets or sell our business assets. Customer information is generally one of the business assets involved in such transactions. Thus, if Avalon Essentials, LLC, or all of its assets are acquired, customer information would be one of the transferred assets.
Avalon Essentials, LLC fully cooperates with law enforcement agencies in identifying those who use our services for illegal activities and may, in its sole discretion, disclose Personal Information or other information to satisfy any law, regulation, subpoena, or government request or in connection with litigation. Avalon Essentials, LLC reserves the right to release Personal Information or other information about users who we believe are engaged in illegal activities or are otherwise in violation of our Terms of Use Agreement, even without a subpoena, warrant or court order, if we believe in our sole discretion that such disclosure is necessary or appropriate to operate the Site or to protect the rights or property of Avalon Essentials, LLC, its affiliates, or any of their officers, directors, or employees, agents, third-party content providers, suppliers, sponsors, or licensors. Avalon Essentials, LLC also reserves the right to report to law enforcement agencies any activities we reasonably believe to be unlawful at our sole discretion.
6. Privacy Preferences/Opt-Out
You can change or update your Personal Information on the Site by accessing your account page.
Avalon Essentials, LLC also offers you control over your privacy preferences through a request submitted at our Unsubscribe page, where you can request not to receive promotional materials from us. You may update these preferences at any time. Please allow ten business days for your preferences to be processed.
If you do not want to receive promotional e-mails from Avalon Essentials, LLC, please follow one of the three options below:
A. You may opt out of receiving promotional e-mails when registering for an account. When providing your account information, uncheck the box that asks whether you would like to receive e-mail updates about our new features, services, and special offers. We will not send you any promotional information via e-mail.
B. You may unsubscribe from receiving promotional e-mails of certain types (or a company-wide unsubscribe) at any time by clicking here to unsubscribe now. Please carefully consider the various options for unsubscribing from our promotional e-mails. You may have the option to unsubscribe from one or more special interest e-mail lists or from all promotional e-mails from us.
C. When you receive a promotional e-mail from Avalon Essentials, LLC, it will contain a link that allows you to stop receiving e-mail messages from us. If you decide to use this opt-out link, you will no longer receive special offers, valuable coupons, new product introductions, and informational health and wellness newsletters from Avalon Essentials, LLC; however, you will continue to receive non-promotional e-mails from us, such as order confirmations.
Transfemme intends to take reasonable and appropriate steps to protect the Personal Information you share with us from unauthorized access or disclosure. When you transmit Personal Information to our servers, your information is protected by both a “firewall” (a combination of computer hardware and software that helps keep unauthorized visitors from accessing information within our computer network) and industry-standard SSL (secure socket layer) encryption. Unfortunately, no data transmission over the Internet or stored on a server can be guaranteed 100% secure. As a result, while we strive to protect your Personal Information and privacy, we cannot guarantee or warrant the security of any information you disclose or transmit to us online and cannot be responsible for the theft, destruction, or inadvertent disclosure of your Personal Information.
If you create an account on the Site, you may be asked to choose a password, in which case your password shall protect your online account information. We recommend that you do not disclose your password to any other person. You are responsible for maintaining the confidentiality of your password and account and are fully responsible for all activities that occur under your password or account.
Credit card information collected by Avalon Essentials, LLC is encrypted through SSL before it is transmitted over the Internet.
This Site is not intended for use by children under the age of 18, and Avalon Essentials, LLC does not knowingly collect or use any Personal Information from such children. If you are under 18, do not submit any information to this Site and do not use this site.
9. Changes to the Privacy Policy
The terms of this Privacy Policy may change from time to time. We will notify you of any material changes to this Privacy Policy by posting a notice on the homepage of the Site for a reasonable period after such changes are made that this Privacy Policy has been updated and by changing the “Last Updated” date at the top of this Privacy Policy. We encourage you to check this page periodically for any changes. Your continued use of the Site after posting changes to these terms will mean you accept those changes. While we support the protection of our customers’ privacy on the Internet, Avalon Essentials, LLC expressly disclaims any liability for the actions of third parties, including but not limited to actions relating to the use and/or disclosure of Personal Information by third parties.
This Privacy Policy and the privacy practices of Avalon Essentials, LLC will be subject exclusively to the laws of the State of Nevada within the United States. Avalon Essentials, LLC makes no representation that this Privacy Policy and our practices comply with the laws of any other country or jurisdiction. Visitors who use the Site and are domiciled outside the United States do so on their initiative and are responsible for compliance with local laws, if and to what extent local laws are applicable. If you reside outside of the United States, by using our Site, you consent to the transfer, processing, and use of your information outside your country. All external packaging is discretely shipped from Avalon Essentials, LLC in a pain box with no reference to the contents or trade names. International shipments will contain required customs documents that are more explicit as to the contents of the box.

Mobile Terms of Service

The Avalon Essentials, LLC mobile message service (the “Service”) is operated by Avalon Essentials, LLC (“Avalon Essentials, LLC”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Avalon Essentials, LLC’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Avalon Essentials, LLC through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Avalon Essentials, LLC. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all SMS/text messages charges, including charges from your wireless provider.
You may opt out of the Service at any time. Text the single keyword command STOP to +18333593509 or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device unless you initiate them. If you have subscribed to other Avalon Essentials, LLC mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
